These Terms of Use ("Terms") are a legal agreement between you and Verdant ("we", "us", or "our") governing your use of the Verdant application ("App"). By downloading, installing, or using the App you agree to these Terms.

1. License

Verdant grants you a limited, non-exclusive, non-transferable, revocable license to use the App on Apple-branded devices that you own or control, in accordance with the Apple Media Services Terms and these Terms.

2. Subscriptions

Verdant Pro is offered as an auto-renewing subscription:

3. AI Features

Verdant uses third-party AI services (currently Google Gemini) to generate responses. AI output may be inaccurate, incomplete, or unsuitable for your purposes. You are responsible for reviewing and verifying any AI output before relying on it. Do not submit confidential or sensitive information through the AI Assistant.

4. Acceptable Use

You agree not to:

5. Intellectual Property

The App, including its design, code, and trademarks, is owned by Verdant and is protected by intellectual property laws. Content that you create within the App remains yours.

6. Third-Party Services

The App relies on services provided by Apple, Google, and other third parties. Your use of those services is also governed by their terms.

7. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Verdant does not warrant that the App will be uninterrupted, error-free, or secure.

8. Limitation of Liability

To the maximum extent permitted by law, Verdant shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or use, arising out of or related to your use of the App. Verdant's total liability for any claim shall not exceed the amount you paid for the App in the twelve months preceding the claim.

9. Apple-Specific Terms

These Terms are concluded between you and Verdant, not Apple. Apple is not responsible for the App or its content. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you (if any). To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.

Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance of these Terms, will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

10. Termination

These Terms remain in effect until terminated by you (by deleting the App) or by us. We may suspend or terminate your access to the App if you violate these Terms.

11. Changes

We may update these Terms. Material changes will be reflected by an updated "Last updated" date. Continued use of the App after changes constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of the jurisdiction in which Verdant is established, excluding conflicts-of-law rules.
